These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Pokemon Traders ("the Platform," "we," "us," or "our") governing your access to and use of the Pokemon Traders website, application, smart contracts, and the $POKETRADE token (collectively, the "Service").

By accessing, browsing, or using the Service in any manner, including but not limited to purchasing, holding, burning, or interacting with the $POKETRADE token, you represent and warrant that:

• You are at least 18 years of age (or the age of majority in your jurisdiction).
• You have the legal capacity to enter into a binding agreement.
• You are not a resident of any jurisdiction where the use of this Service is prohibited.
• You understand and accept all risks associated with cryptocurrency and decentralized finance (DeFi).
• You have read and understood these Terms in their entirety.

The $POKETRADE token is a meme token created solely for entertainment, community engagement, and experimental purposes on the Solana blockchain. The token is not a security, investment contract, commodity, currency, or financial instrument of any kind.

The $POKETRADE token:

• Is not offered or sold as an investment and carries no expectation of profit from the efforts of others.
• Does not represent any ownership, equity, share, royalty, or right to capital, dividends, or distributions in any entity.
• Does not confer any governance rights, voting rights, or decision-making authority over the platform or any entity.
• Is not backed by any asset, revenue stream, collateral, or guarantee of any kind.
• Was not offered through any initial coin offering (ICO), initial exchange offering (IEO), or securities offering.
• Is a decentralized token deployed on a public blockchain with no centralized control over its price or market.

The $POKETRADE token exists purely as an access mechanism for the Platform's features and for community participation. Any market value that the token may acquire on secondary markets is entirely determined by market forces beyond our control and should not be interpreted as an endorsement, guarantee, or representation of value by us.

WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE VALUE OF THE $POKETRADE TOKEN.

You expressly acknowledge and agree that:

• The $POKETRADE token has no inherent or intrinsic value.
• There is no promise, representation, or guarantee that the token will maintain any particular value or any value at all.
• The price of the token may decrease to zero at any time and without notice.
• We do not and will not engage in market-making, price stabilization, or any activity intended to artificially influence the token price.
• Any purchase of the token should be treated as a complete loss of the funds used for the purchase.
• You should not purchase the token with money you cannot afford to lose entirely.
• The token should not be viewed as a store of value, medium of exchange, or unit of account.

The Pokemon Traders platform, including all AI trading functionality, smart contracts, and related software, is provided on an "AS IS" and "AS AVAILABLE" basis as experimental software.

You acknowledge that:

• The Platform is experimental and may contain bugs, errors, vulnerabilities, or defects.
• The AI-powered trading features are experimental technologies that may not perform as expected.
• Smart contracts are immutable once deployed and may contain undetected vulnerabilities.
• The Platform may experience downtime, disruptions, or failures at any time.
• Features may be added, modified, paused, or removed without prior notice.
• No warranty, representation, or guarantee of uptime, reliability, accuracy, or fitness for any purpose is made.
• The automated trading system does not guarantee profits and may result in complete loss of funds.

Cryptocurrency and decentralized finance involve substantial risks. By using the Platform, you represent that you understand and accept the following risks:

• Market Risk: Cryptocurrency markets are highly volatile. The value of tokens (including $POKETRADE and any tokens traded by the AI system) can fluctuate dramatically and may lose all value.
• Smart Contract Risk: Interactions with smart contracts on the Solana blockchain carry inherent risk of bugs, exploits, or unintended behavior.
• Liquidity Risk: There is no guarantee of liquidity for $POKETRADE. You may not be able to sell or trade your tokens.
• Regulatory Risk: Cryptocurrency regulation varies by jurisdiction and is subject to change. Future regulations may adversely affect the Platform or the token.
• Technology Risk: Blockchain technology, AI systems, and decentralized applications are experimental. System failures, network congestion, or third-party service outages may affect the Platform.
• Counterparty Risk: The Platform interacts with third-party protocols (Jupiter, PumpPortal, Raydium) that are outside our control.
• Irreversibility Risk: Blockchain transactions are irreversible. Tokens sent to wrong addresses or burned tokens cannot be recovered.
• Loss of Private Keys: If you lose access to your wallet or private keys, your tokens are permanently lost.
• Automated Trading Risk: The AI-powered trading system makes decisions autonomously and may execute trades that result in losses, including total loss of trading funds.

Nothing contained on the Platform, in these Terms, or in any communication from us constitutes:

• Financial advice or a recommendation to purchase, sell, hold, or burn any token.
• Investment advice or a solicitation to invest in any asset or venture.
• Legal advice regarding cryptocurrency regulations in your jurisdiction.
• Tax advice regarding the tax implications of purchasing, selling, burning, or holding tokens.
• Professional advice of any kind.

You are solely responsible for your own due diligence and should consult with qualified financial, legal, and tax professionals before making any decisions related to the Platform or $POKETRADE token. We are not licensed as financial advisors, broker-dealers, or investment advisors in any jurisdiction.

Pokemon Traders is a community-created meme project with a Pokemon-inspired theme.

• Pokemon Traders is NOT affiliated with, endorsed by, sponsored by, or associated with Nintendo, The Pokemon Company, Game Freak, or any of their subsidiaries or affiliates.
• "Pokemon" and all related character names, designs, and trademarks are the property of their respective owners.
• The use of Pokemon-inspired themes, names, and imagery on this platform is purely for entertainment, parody, and community purposes within the meme token culture.
• We do not claim ownership of any Pokemon intellectual property. All Pokemon trademarks belong to their respective owners.
• This project is a satirical, community-driven meme token experiment and should be understood as such.
• If any intellectual property holder objects to the use of their property, we will promptly comply with any valid takedown or cease-and-desist request.

You agree not to use the Platform for any of the following purposes:

• Any illegal activity, including but not limited to money laundering, terrorist financing, or sanctions evasion.
• Manipulation of the $POKETRADE token price through wash trading, spoofing, or other deceptive practices.
• Exploiting vulnerabilities, bugs, or errors in the Platform or associated smart contracts.
• Interfering with the Platform's operation or the experience of other users.
• Using bots, scrapers, or automated tools to interact with the Platform in unauthorized ways.
• Misrepresenting the $POKETRADE token as a security, investment, or financial instrument.
• Promoting the token with false, misleading, or deceptive claims about its value, utility, or expected returns.
• Using the Platform while located in a jurisdiction where such use is prohibited.

The Platform is not intended for use by persons in jurisdictions where the use of cryptocurrency platforms is prohibited or restricted by law. You are solely responsible for ensuring compliance with all applicable laws and regulations in your jurisdiction.

The Platform is expressly not available to residents of:

• Any jurisdiction where cryptocurrency trading is illegal or restricted.
• Countries subject to comprehensive sanctions by the United States (OFAC), European Union, United Kingdom, or United Nations.
• Any jurisdiction that classifies meme tokens as regulated securities without appropriate exemptions.

We make no representations that the Platform is appropriate or available for use in any particular jurisdiction. By using the Platform, you confirm that you are legally permitted to do so under the laws of your jurisdiction.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• IN NO EVENT SHALL THE PLATFORM, ITS CREATORS, DEVELOPERS, CONTRIBUTORS, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF TOKENS, LOSS OF VALUE, OR LOSS OF GOODWILL.
• OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ZERO DOLLARS ($0.00), WHICHEVER IS GREATER.
• YOU ASSUME ALL RISK OF LOSS RESULTING FROM YOUR USE OF THE PLATFORM AND INTERACTION WITH THE $POKETRADE TOKEN.
• YOU AGREE TO INDEMNIFY AND HOLD HARMLESS THE PLATFORM AND ITS CREATORS FROM ANY CLAIMS, DAMAGES, OR LOSSES ARISING FROM YOUR USE OF THE SERVICE OR VIOLATION OF THESE TERMS.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.

We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform following any changes constitutes your acceptance of the revised Terms.

It is your responsibility to review these Terms periodically. We may, but are not obligated to, notify you of material changes via the Platform or other means.
